1. Introduction

This Herald Member Agreement governs the use of accounts, profiles and member services provided through the Elsenham Herald website and related Herald applications.

The Elsenham Herald is operated by Knelstrom Ltd, referred to in this Agreement as “the Herald”, “we”, “our” or “us”.

By creating or using a Herald account, you agree to this Agreement.

This Agreement applies to all current and future Herald applications, including:

• Events
• Directory
• Community
• Contributor profiles
• Media submissions
• News tips
• Marketplace services
• Classified listings
• Forums
• Other services introduced through the Herald platform

Some applications may also have additional service-specific terms.

2. Eligibility

You must provide accurate information when creating or maintaining an account.

You must be at least 18 years old to enter into paid transactions, licensing arrangements or contracts through the Herald unless a parent or legal guardian has provided permission.

You are responsible for ensuring that your use of the Herald complies with applicable law.

3. One Herald Account

A Herald account may be used across multiple Herald applications.

Your account may allow you to:

• Submit events
• Create Directory listings
• Participate in Community services
• Submit photographs or video
• Maintain a public profile
• Access dashboards
• View submissions
• Receive notifications
• Track activity
• Access future Herald applications

You do not need to create a separate account for each application.

4. Account Information

You agree to provide accurate and current information.

You must not:

• Impersonate another person
• Create an account using false details
• Use another person’s account without permission
• Allow another person to use your account improperly
• Attempt to gain unauthorised access to another account

You are responsible for keeping your password secure.

You should notify the Herald if you believe your account has been compromised.

5. Public Profiles

Herald members may have a public profile.

A public profile may display:

• Display name
• Profile photograph
• Biography
• General location
• Website
• Social media links
• Member since date
• Verified status
• Number of submitted events
• Number of Directory listings
• Number of Community contributions
• Number of media submissions
• Number of licensing sales
• Published content
• Achievements or badges
• Activity from future Herald applications

The Herald will not publicly display private payment information, passwords or private contact details.

Members are responsible for ensuring that information placed on their public profile is lawful, accurate and appropriate.

6. Application Activity

Each Herald application may contribute information to your overall member profile.

For example, your profile may show:

• Events submitted
• Directory listings created
• Community posts published
• Photos or videos contributed
• Licensing sales recorded
• Marketplace listings
• Future application activity

Only content considered public or approved for publication will normally appear on public profiles.

Rejected, draft, private or confidential content will not normally be displayed publicly.

7. Member Conduct

You must use the Herald responsibly.

You must not submit, publish or distribute material that:

• Is unlawful
• Is defamatory
• Is threatening
• Encourages violence
• Is deliberately false or misleading
• Infringes copyright
• Invades privacy
• Contains malicious software
• Promotes fraud
• Includes unauthorised personal data
• Is abusive or harassing
• Is spam
• Is intended to manipulate Herald services
• Falsely represents a business, event or organisation

The Herald may remove content that breaches these rules.

8. Accuracy

You are responsible for the accuracy of information you submit.

This includes:

• Event dates and times
• Business details
• Contact information
• Community notices
• News tips
• Profile information
• Images
• Video
• Descriptions
• Claims about individuals or organisations

You must correct information promptly if you discover that it is inaccurate.

9. Events

When submitting an event, you confirm that:

• The event information is accurate
• You have authority to submit it
• Contact details are valid
• Ticketing information is accurate
• Any images used are owned by you or properly licensed
• You will update or cancel the listing if circumstances change

Publication does not mean the Herald organises, endorses or accepts responsibility for the event.

10. Directory Listings

When creating a Directory listing, you confirm that:

• The business, organisation or service is genuine
• You are authorised to represent it
• The information is accurate
• Images and logos are owned or properly licensed
• Claims made in the listing are not misleading
• Contact details are current

The Herald may edit, suspend or remove inaccurate or misleading listings.

11. Community Content

Community content must be relevant, lawful and respectful.

The Herald may moderate, edit, delay, reject or remove Community submissions.

Publication does not mean the Herald endorses the views expressed by a member.

12. Photographs and Video

Submitting photographs or video may require acceptance of the separate Media Contributor and Licensing Agreement.

The Media Contributor and Licensing Agreement applies in addition to this Member Agreement.

13. Copyright

You retain ownership of original material you create, unless otherwise agreed.

By submitting content for publication, you grant the Herald a non-exclusive licence to:

• Review it
• Store it
• Edit it
• Format it
• Publish it
• Promote it
• Archive it
• Display it in connection with your profile
• Use it to operate the relevant Herald application

Additional licensing terms may apply to photographs, video, marketplace products or paid services.

14. Editorial Control

The Herald retains editorial control over all Herald websites and applications.

We may:

• Reject submissions
• Edit titles
• Correct spelling and grammar
• Amend formatting
• Remove unlawful material
• Add warnings or context
• Correct factual errors
• Move content between categories
• Remove duplicate material
• Suspend publication
• Decline to publish content

Submission does not guarantee publication.

15. Verification

The Herald may verify:

• Identity
• Business ownership
• Event authority
• Copyright ownership
• Submitted facts
• Payment information
• News claims
• Professional credentials

Verified status may be awarded, withheld or withdrawn at the Herald’s discretion.

Verification does not amount to a guarantee or endorsement.

16. External Links

Members may add websites and social media links to their profiles.

You must not link to:

• Illegal content
• Malware
• Fraudulent websites
• Copyright-infringing material
• Abusive or extremist material
• Misleading commercial schemes
• Adult material unsuitable for a community platform

The Herald is not responsible for external websites.

17. Paid Services

Some Herald services may require payment.

Prices, renewals, durations and refund conditions will be shown before purchase.

Paid placement does not guarantee editorial coverage, endorsement, traffic, sales or enquiries.

Editorial decisions are separate from advertising and paid listings.

18. Suspension and Termination

The Herald may restrict, suspend or terminate an account where:

• This Agreement is breached
• Fraud is suspected
• False information is provided
• Copyright is repeatedly infringed
• A user threatens or harasses others
• The platform is misused
• Payment obligations are not met
• Continued access presents a legal, security or reputational risk

Where appropriate, the Herald may provide an explanation.

Serious breaches may result in immediate suspension.

19. Account Closure

You may request closure of your account.

Closing an account does not automatically remove:

• Content already published
• Event listings already archived
• Directory records required for accounting
• Material already licensed
• Records required by law
• Content retained for editorial or legal purposes

Public profile information will normally be removed or anonymised where reasonably possible.

20. Privacy

Personal data is handled in accordance with the Herald Privacy Policy.

Different Herald applications may collect different information depending on the service used.

Payment details will not be displayed publicly.

21. Availability

The Herald does not guarantee that applications will always be available.

Services may be:

• Updated
• Replaced
• Suspended
• Merged
• Discontinued
• Temporarily unavailable

The Herald may add new applications to the shared account system.

22. Liability

The Herald does not guarantee:

• Publication
• Website traffic
• Event attendance
• Business enquiries
• Media sales
• Licensing income
• Profile visibility
• Marketplace sales
• Continuous platform availability

To the fullest extent permitted by law, the Herald is not liable for indirect or consequential loss arising from use of the platform.

Nothing in this Agreement excludes liability that cannot legally be excluded.

23. Changes to This Agreement

The Herald may update this Agreement as services develop.

Material changes will be published on the website.

Continued use of a Herald account after an updated Agreement takes effect may be treated as acceptance of the revised terms.

24. Governing Law

This Agreement is governed by the laws of England and Wales.

The courts of England and Wales will have jurisdiction over disputes arising from this Agreement.
